Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Custody
A court has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to answer human smuggling allegations, he was held in federal detention.
In her decision, the judge noted that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The court proceedings involve disputed assertions. While the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he vehemently denies this allegation.
He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing trial in Tennessee.
Terms of Freedom
The court, who was hearing his challenge to deportation in a Maryland district court, ruled that he must now adhere to the terms of his bond from custody in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
This ruling marks a notable turn in a complex immigration case featuring claims of mistaken imprisonment and disputed criminal associations.
